AI Use & Output Disclaimer

How AI-assisted features work inside Superadjust, what the outputs are, what they are not, and how users must use them.

1. About this Disclaimer

This AI Use and Output Disclaimer explains how AI-assisted features work inside Superadjust, what the outputs of those features are, what they are not, and how users must use them.

This Disclaimer applies to anyone who uses Superadjust's AI-assisted features. It applies whether the user is a teacher using the platform on their own, a teacher operating under a school account, a coordinator, a school administrator or any other authorised user.

This Disclaimer should be read together with the Privacy Policy, the Acceptable Use Policy, the Teacher Platform Terms of Service and the School Services Agreement. Where there is any conflict between this Disclaimer and the Teacher Platform Terms of Service or the School Services Agreement on the question of what AI outputs may be used for, the Terms of Service or School Services Agreement prevails.

Superadjust is operated by Superhive Pty Ltd trading as Superadjust (ABN 58 683 676 584).

2. What Our AI Features Do

Superadjust includes optional AI-assisted features designed to help educators with evidence-related tasks. These features are powered by a third-party AI service provider hosted in Microsoft Azure infrastructure.

The AI-assisted features currently include:

  • Pillar detection: Suggesting which NCCD evidence pillar (Adjustments, Consultation, Monitoring or Need) an evidence note is most likely to relate to, based on the content of the note.
  • Evidence enhancement: Helping rephrase or improve the clarity of evidence text that the user has already entered.
  • Adjustment generation: Generating draft adjustment ideas, lesson modifications, activity suggestions or resource drafts based on a student's NCCD profile and the user's request.
  • Readiness signalling: Surfacing readiness signals across the four NCCD pillars based on the evidence recorded for a student.

3. What Our AI Features Are Not

AI-assisted features inside Superadjust are not, and do not provide, any of the following:

  • A medical, psychological or clinical opinion.
  • A diagnosis or assessment of a student.
  • A determination of NCCD level of adjustment.
  • A final decision about NCCD categorisation.
  • An Individual Learning Plan, Behaviour Support Plan, or any other formal student plan.
  • Legal advice, compliance advice, audit advice or funding advice.
  • A guarantee that any evidence will be sufficient for NCCD submission, audit, review or funding purposes.
  • A substitute for professional judgement, school review, parent or carer consultation or specialist advice.

4. Prohibited Uses of AI Outputs

You must not use an AI output, on its own and without independent professional review, as the basis for:

  • Determining or finalising a student's NCCD level of adjustment or category.
  • An NCCD funding submission.
  • An Individual Learning Plan or Behaviour Support Plan.
  • A diagnosis, clinical conclusion or health-related decision.
  • A decision that materially affects a student's educational program.
  • A disciplinary or welfare decision affecting a student.
  • A recruitment, performance or staffing decision affecting a teacher.
  • Any other decision that could significantly affect a person's rights, interests or wellbeing.

5. Human Review Is Mandatory

Every AI output must be reviewed by a qualified educator or authorised school staff member before being saved, exported, shared or relied on.

Reviewing an AI output means reading the output carefully, checking it for accuracy, relevance and appropriateness for the specific student or context, editing the output where you do not agree with it, rejecting the output where it is not appropriate, and accepting responsibility for the final saved or shared version.

Once an AI output is accepted and saved by a user, the saved record is treated as the user's evidence or content. The user is responsible for that record from the point of saving onwards.

6. How AI Processing Works

When a user uses an AI-assisted feature, the information entered into that feature may be sent to a third-party AI service provider hosted in Microsoft Azure infrastructure for processing. AI processing for Superadjust occurs in the Australia East region.

The third-party AI service provider returns a response, which Superadjust shows to the user. The user can then edit, accept or reject the response.

We do not use customer data to train AI models, and we do not intentionally permit customer data to be used to train AI models. We do not store raw AI prompts in our backend as a separate persistent record. Operational logs that may contain prompt content are retained only for the period necessary for security, error monitoring and service operation.

Where an AI output is saved by a user inside the platform, that saved output is stored in the same way as any other user-saved content and is governed by our Privacy Policy and Data Retention Schedule.

7. Information You Must Not Enter Into AI Features

You must not enter information into AI features that you would not be authorised to enter into Superadjust generally. This includes the prohibited content categories in the Acceptable Use Policy.

In addition, you must not use AI features to ask the AI to diagnose a student, ask the AI to generate misleading, fabricated or backdated evidence, ask the AI to create content you are not authorised to store or use, enter unnecessary sensitive information, profile, shame, rank or unfairly target a student, or attempt to extract or reproduce content from third-party copyrighted sources.

8. Output Quality and Accuracy

AI outputs may be incomplete, inaccurate, inappropriate, biased or not suitable for a particular student or context. AI outputs may also produce content that appears confident but is wrong.

To the maximum extent permitted by law, Superadjust does not warrant that any AI output is accurate, complete, current, suitable for any particular purpose, free from error or appropriate for a specific student.

Nothing in this Disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

9. Ministerial Framework for AI in Schools

Superadjust's AI-assisted features are designed to be used in a way that is consistent with the principles of the Australian Government's Framework for Generative AI in Schools, including:

  • Teaching and learning: AI features assist educators with administrative and evidence-related tasks, not to replace teaching.
  • Human and social wellbeing: AI outputs are not used to make decisions about students. Decisions remain with qualified educators and schools.
  • Transparency: AI processing is disclosed in this Disclaimer and in the Privacy Policy. Users can see when AI is being used.
  • Fairness: AI outputs must be reviewed by humans before use to reduce the risk of bias affecting students.
  • Accountability: Schools and users remain accountable for decisions made using Superadjust.
  • Privacy, security and safety: AI processing is configured so that customer data is not used to train AI models, and is hosted in Australia where reasonably practicable.

10. School AI Policies

Some schools, sectors or jurisdictions have their own policies on the use of AI in education. These may include rules about which AI tools may be used, how they may be used, what information may be shared with them, and how AI-generated content must be reviewed.

Schools and users are responsible for ensuring that their use of Superadjust's AI-assisted features is consistent with any school, sector, diocesan, state or territory AI policy that applies to them.

If a school decides not to permit AI-assisted features, the school may disable those features for its account where the platform supports it. Coordinators should contact Superadjust to discuss configuration options if needed.

11. Privacy and AI

Information processed by AI-assisted features is handled in accordance with our Privacy Policy. In summary: AI processing occurs in Microsoft Azure infrastructure in the Australia East region; we do not use customer data to train AI models; we do not store raw AI prompts as a separate persistent record; saved AI outputs are stored alongside the user's other content and are subject to the same retention and access controls; and schools remain responsible for ensuring they have the authority and consent required to enter student information into AI features.

You must not enter sensitive information into AI features beyond what is reasonably necessary for the educational purpose.

12. Liability and AI Outputs

To the maximum extent permitted by law, Superadjust is not liable for any decision, outcome, loss or harm arising from the use of an AI output, including any decision to rely on an AI output without human review, use an AI output as the sole basis for a decision listed in section 4, save, export or share an AI output without checking it, or act on an AI output that turns out to be inaccurate, incomplete, inappropriate or unsuitable for the user's context.

Liability under the Teacher Platform Terms of Service or the School Services Agreement, including consumer guarantees that cannot be excluded under the Australian Consumer Law, continues to apply.

13. Reporting Concerns About AI Outputs

If you believe an AI feature has produced harmful, unsafe, biased, inappropriate or seriously inaccurate output, please contact us at privacy@superadjust.com.

Where appropriate, we will investigate and may adjust how the relevant AI feature operates, add additional safeguards or warnings, disable the feature temporarily or permanently, notify the relevant school or coordinator, and update this Disclaimer.

14. Changes to This Disclaimer

We may update this Disclaimer from time to time. If we make material changes, we will take reasonable steps to notify users or schools, such as by posting an updated version on our website, updating the effective date, providing in-app notice or emailing relevant account contacts.
